If your debtor has no assets – there is no recovery. It’s as simple as that. Of course, that doesn’t mean you give up – it’s gaining around 10% ointerest annually – which is nice.

A few months is not unusual. All cases vary, and sometimes it could take up to a year – or longer. It all depends on the assets a debtor may or may not own – and how large the judgment is. Keep in mind that the judgment continues to gain interest.

There are times when it may be beneficial to settle for less than the face amount.  Again, it really depends on what “type” of debtor we’re dealing with here. Either way, a 50/50 split on the collected amount is a standard agreement.
